What Are Civil Rights and Civil Liberties?
The term “civil liberties”11 generally means the freedom from intrusive or undue government interference, while “civil rights”12 refers to the rights of individuals to participate fairly and equally in society and the political process. Civil liberties are generally spoken of in the negative—what government cannot do—whereas civil rights are generally positive13 (or affirmative)—what the government must or should do to ensure equality and fairness. Civil liberties offer protection to individuals from improper government action and arbitrary governmental interference. Privacy is coupled more naturally with civil liberties because privacy is a concept about prohibiting certain intrusions.
